Paragard IUD Lawsuits – Risks, Complications and Why You Should Speak With an Attorney.
There are many birth control methods available for women in today’s marketplace. In recent times, more women are turning to Intrauterine Contraceptive Devices, commonly known as IUDs. One popular choice for this birth control method is Paragard IUD. With their compact, hormonal-free T-shape design, Paragard can be inserted by a medical professional within minutes.
However, the Paragard IUD has recently been connected to serious complications and injuries in patients. Women have begun filing lawsuits against the manufacturer, Teva Pharmaceuticals, due to complications arising with IUDs becoming embedded in the uterus; perforation (the creation of a hole made by piercing) of the uterus and parts of the IUD breaking off, requiring surgical removal. The company has also faced claims that they have failed to provide adequate warnings about the risks involved with using the product.
We are currently investigating cases in which the use of the Paragard IUD caused dangerous side effects and have impaired fertility of those ready to have children. If you or a loved one have used a Paragard IUD and have suffered from these types of injuries, you may be eligible to file a Paragard IUD lawsuit.
Paragard IUD Complications? Enough Said. Ask Ed.
What is a Paragard IUD (intrauterine contraceptive device)?
Approved by the FDA in 1984, Paragard IUD has become a common choice for women looking for a non-hormonal birth control method. Paragard is currently the only copper IUD available in the United States and can prevent pregnancy for up to 10 years after implantation. It is perceived as low maintenance and is designed for females looking for a no-hassle approach to staying protected against pregnancy.
The Paragard website states that its “product may be difficult to remove at times” and that “surgery may be necessary.” The website also states that its IUD is “99% effective at preventing pregnancy.” While the site warns of common side effects associated with the product, they only include “heavier, longer periods and spotting between periods”, and states that “this will usually diminish after two to three months. Women who experience heavy or longer periods after 3 months are urged to contact a healthcare professional.” However, the site does not warn about some of the other injuries that have been linked to the product.
What is the problem?
While the Paragard IUD contraceptive works well for many, some have endured serious complications during device removal. In the years after implantation, the device’s T-arm can become lodged or embedded into the uterine wall where the T-arm can then break.
Not only can this design flaw potentially impair fertility and lead to painful surgical removal of the T-arm, but it can also cause a host of other problems including uterine damage. Women with the Paragard IUD have required a hysteroscopy, laparotomy and in some cases, a complete hysterectomy due to the near-impossible retrieval of the arm once it breaks. The retrieval process can be extremely difficult as a woman’s uterus contracts and obstructs the view of the device.
In 2015, the Open Journal of Clinical & Medical Case Reports published a study of Chicago gynecologists over a period of 3 years. The study found 7 instances of an IUD T-arm break over the 3-year time frame. All of the patients required a hysteroscopic removal and one study participant was unable to have the arm removed. Experts have suggested that these breaks are heavily underreported.
There is also a risk that the Paragard IUD will perforate the wall of the uterus and has been reported to happen when the doctor first implants it. Perforation can cause additional complications including; infection, scarring, and damage to other nearby organs. Surgery is often needed to correct these types of problems.
Furthermore, in the rare event that pregnancy does occur while the Paragard IUD is still in place, there is an increased risk that the pregnancy will be ectopic (outside the uterus) and puts the patient in danger. This emergency situation requires immediate medical attention that often involves surgery. There is always a risk that an ectopic pregnancy can cause internal bleeding, infertility, or even death.
