Everybody means well, but you’re getting a constant stream of mixed information, too many opinions, conflicting stories about what you should do, and more rumors than facts! Let Ed Bernstein & Associates help.
How Workers Compensation Should Work
In a perfect world, the workers' compensation system is designed to protect both employers and employees. Employers don’t face a never-ending stream of injured employees who want to sue them for liability, and those same employees are better able to secure needed treatments for injuries or illnesses suffered.
But as we all know, the world is far from perfect and things hardly ever go as planned.
Every business in the State of Nevada that employs one or more is required by law to carry workers compensation. Simple enough, but you won’t believe how complex even a basic concept like that can get!
Can I get workers comp if I’m employed by a relative?
Who ensures all this; an insurance company or can my employer be running their own in-house deal somehow?
The short answer is that even if all the employees at a company are relatives, the company must carry workers comp. The policy has to be written by a licensed insurer who is authorized by the Division of Insurance. Some employers are big enough and well enough funded that they are self-insured. Some companies might even have a third-party administrator. Do you know how your company’s workers compensation is set up? Think you might need an attorney?
You’re hearing stories:
Stories about people who were working for a subcontractor and told the general contractor is responsible for claims
People who thought they were employed but discovered they were contracted as a 1099 whatever that is.
About people who filed a workman’s comp claim and got denied. Maybe your claim was denied.
What seemed perfectly simple becomes the massive mess you’re feeling so trapped in now.
You’re hurt. Ill, not feeling well. Thinking about medical bills piling up. Wondering if you’re up to dealing with all this. Quit wondering and stop the anxiety. Enough Said. Call Ed. Ed Bernstein & Associates.
